    NLRB member Richard Griffin, whose appointment to the board bypassed the Senate through a recess appointment (even though the Senate was not in recess), is the former chief counsel for the International Union of Operating Engineers (IUOE).     Unfortunately though, the White House has decided against standing with workers and small businesses and instead, has sided with labor bosses desperately seeking “payback.” After having invested half a billion dollars in President Obama’s election in 2008, union bosses have demanded gifts in return for their political contributions.     Job creators are badly in need of certainty as they work, which includes relief from the proliferation of these micro-units, which would result in greater unemployment and business closures at the worst possible time.[16] Therefore, the vote to prohibit the use of taxpayer dollars in the formation of micro-unions in private sector workplaces will serve as a real test for members of the Senate Appropriations Committee.     Recently, the board’s “ambush election” rule was struck down by a federal judge[7], while its Specialty Healthcare decision cleared the way for a micro-union to be formed at a Bergdorf Goodman store in New York where women’s shoes associates on two separate floors were allowed to form a collective bargaining unit.[8]

    Clearly, with unemployment over eight percent for 40 consecutive months[9] and anemic job creation in May, the American people are focused on the economy and they understand unelected government bureaucrats issuing regulations will only negatively impact employees and employers at the worst possible time.
